MILITARY HIGH COURT MAINTAINS THE INITIAL VERDICT OF LIFE IMPRISONMENT TO SGT MINANI
Nyamasheke, 7 February 2025
The military high court has maintained the life sentence imprisonment verdict to Sgt Minani after 2 days of hearing on his appeal at the same place where he committed the crime in Nyamasheke District.
After receiving Sgt Minani Gervaisâ appeal request, the Military High Court set the hearing date from 6 to 7 February 2025.
The trial was conducted publicly where the crime occurred at Rubyiruko village, Rushyarara cell, Karambi sector in Nyamasheke District.
Sgt Minani Gervais had previously been convicted and sentenced to life imprisonment by the military tribunal for allegedly shooting and killing five people in Nyamasheke District.
During the appeal, Sgt Minani and his legal representative explained that he was not feeling well and lacked legal counsel during his initial trial.
He requested to requalify the crime from voluntary murder to manslaughter, arguing that he was provoked by the victims before committing the criminal act. He also requested a reduction of sentences.
The military prosecution argued that the accussed lacked legal basis for appeal, and requested the military high court to maintain the same sentence rendered by the military tribunal.
After reviewing the appeal, the Military High Court concluded that there was no provocation and sentenced Sgt Minani Gervais to life imprisonment and additional penalty of stripping off his military rank.
Mukankusi Athanasie, the vice-mayor in charge of social affairs in Nyamasheke District and representing the Mayor, confirmed that the victimsâ families and citizens were happy with conclusion of the trial.
She further assured that the district would assist the victimsâ families in seeking compensation through legal channels.
